The Crowdster platform ("Platform") is offered at www.crowdster.eu and on the Crowdster mobile app by the company Crowdlending Europe AB, Org-No: 5595215350 ("Crowdster") with registered address at Drottvägen 7a, 182 64 Djursholm, Sweden. The company can be contacted by email at hello@crowdster.eu.
By approving these "User Terms for Crowdster.eu" ("User Terms"), you are considered an "Investor" (as defined below) and thereby confirm that:

If you do not represent a company or other legal entity, you are investing exclusively on your own account and not on behalf of anyone else in any form, i.e., not as an authorized representative, signatory, contractor, or similar.
Crowdster operates an investor network ("Investor Network") consisting of individuals and legal entities who have indicated their interest in Property Investments on the Platform and have approved the User Terms ("Investor"). The Platform serves as a link between property companies needing capital ("Property Company") and Investors.
When logged into the Platform, an Investor can express interest in specific Investments by "reserving shares" by filling out a form directly on the Platform. Investors who "reserve shares" can then submit an investment offer by signing an electronic subscription agreement ("Subscription Agreement") or an electronic, simple, non-transferable debt instrument ("Loan Agreement").
Reservation of shares is considered an expression of interest and is not binding for the Investor. A legal obligation only arises upon signing the electronic Subscription Agreement or alternatively the Loan Agreement. No fees are imposed on Investors for using the Platform. Signing of the Subscription Agreement or Loan Agreement occurs with digital signature in ContractCloud.
The Investor Network and Platform are operated by Crowdster. Crowdster functions as a link between Investors and Property Companies, which means Crowdster neither directly nor indirectly operates, manages, owns, or is responsible for any investment. Crowdster handles no capital and does not receive payments. All payments related to Property Investments occur directly to and from a special deposit account belonging to the respective Property Company party to the Loan Agreement, at a bank or client account with a lawyer.
Crowdster takes potential money laundering and terrorist financing seriously and has therefore implemented measures equivalent to those financial institutions are subject to. According to the Law on Preventive Measures against Money Laundering and Terrorist Financing, financial companies must introduce a series of preventive measures.
For this purpose, Investors are required to correctly, completely, and truthfully answer all questions in the questionnaire that appears when an Investor has reserved shares on the Platform and to upload proper documentation of their identity in the form of a copy of passport/driver's license and health card. Furthermore, identity verification occurs before an Investment is completed by electronically signing the Subscription Agreement or Loan Agreement in ContractCloud using BankID.
When the Loan Agreement is signed by the Investor, it is binding for them, but is only final when the Investor has provided documentation of their identity and this has been approved by Crowdster.
As part of Crowdster's preventive measures against money laundering and terrorist financing, Investors investing as individuals (i.e., not investing as representatives of a company or other legal entity) are not allowed to invest on behalf of others in any form, neither as authorized representatives nor similar. No Investments are directly or indirectly addressed to persons who are resident, registered, and/or tax liable outside the EEA (European Economic Area). Persons who are resident, registered, and/or tax liable outside the EEA may neither sign up for the Crowdster Investor Network nor complete any Investment.
The Investor is fully responsible for using the Platform in accordance with these User Terms, legislation, and industry practices. The Investor commits not to spread or disclose information, materials, or offers related to Investments to the public or to third parties who are not considered Investors in accordance with the User Terms.
The Investor is obligated to ensure that login information is not shared with third parties and must immediately inform Crowdster if login information is lost or falls into the wrong hands. Crowdster assumes no responsibility for any damages resulting from a third party using the Investor's Platform login information.
Crowdster reserves the right to immediately block the Investor's accounts and/or remove "Investor" status if the Investor does not comply with the User Terms and/or if the Investor's actions, in Crowdster's opinion, directly or indirectly damage or risk damaging Crowdster and/or the Platform.
Crowdster and/or third parties hold all ownership and intellectual property rights to the Platform and the programs that operate the Platform. Investors exclusively have the rights expressly stated in the User Terms. The Investor acknowledges that the Platform's images, texts, and other content are protected by intellectual property rights and confirms not to use or apply these.
Crowdster neither directly nor indirectly provides any license or usage rights to the images, films, texts, or other content found on the Platform.
The Investor understands and accepts that the Platform and the programs on which the Platform is built are protected by intellectual property rights owned by Crowdster and/or third parties. Programs and similar may not be copied, modified, or translated, and their codes may not be examined or decrypted.
Crowdster processes the Investor's personal data to provide access to the Platform and relevant information about Property Investments and/or other services, for other business purposes, to develop the Platform, and to fulfill obligations under the law.
For a more detailed description of which personal data Crowdster processes, why they are processed, and how personal data is protected, refer to Crowdster's privacy policy at: https://www.Crowdster.com/legal/risk. The current privacy policy constitutes an integral part of the User Terms, and the Investor approves that Crowdster processes personal data in accordance with the privacy policy.
By accepting the User Terms, the Investor consents to Crowdster or Crowdster's partners directing direct marketing to the Investor via email or otherwise. The Investor has the right at any time to revoke consent to direct marketing by contacting Crowdster at hello@Crowdster.eu or unsubscribing from the mailing list.
This point applies only to Investors who are individuals acting in their capacity as individuals and not as representatives of a legal entity. According to EU consumer protection rules, an Investor can withdraw within 14 days after being registered as an Investor by sending an email to hello@Crowdster.eu.
Under the Consumer Contracts Act, Crowdster must disclose the following:
The right of withdrawal applies only to registration on the Platform, not to the Investments themselves. The Investor thus has no right of withdrawal when making a binding commitment to participate in Investments.
The Platform may from time to time be wholly or partially unavailable due to maintenance or other reasons. Crowdster assumes no responsibility under any circumstances for any consequences or damages resulting from the Platform not being usable as intended.
Cookies are necessary to make the Platform function. Cookies also help us gain an overview of your visit to the Platform, allowing us to continuously optimize and tailor the website to your needs and interests. A cookie is a small data file stored on your computer, tablet, or mobile phone. A cookie is not a program that can contain harmful programs or viruses.

As a user of the Platform, you understand and accept that the service's functionality, quality, and availability may be degraded or prevented if you do not approve the use of cookies. Crowdster assumes no responsibility for information placed or retrieved from your device via any external cookies.
The agreement constituted by the User Terms continues until terminated by either party. Crowdster may change the User Terms from time to time and will in such case publish the amended User Terms on the Platform. The changed terms become valid for new users and Investors from the date of publication. Existing Investors will be bound by the changed terms 14 days after receiving notification via email or through publication on the Platform.
If an Investor does not approve the changed User Terms, the Investor must terminate the agreement no later than 14 days after the date the changed terms were published on the Platform.
Crowdster provides no recommendations, advice, or guarantees regarding Investments. Crowdster offers only a technical tool and a bulletin board for Property Companies and has no responsibility or insight into the investment, marketing, or offer. The Investments marketed on the Platform are normally associated with high risk. They typically involve top financing without or with subordinated securities. Behind the Investment usually stand smaller actors with limited financial resources.
Virtually all Investments marketed on the Platform are associated with risks that banks or credit institutions do not accept. This is also why the budgeted return is unusually high. Anyone not considered an experienced property investor should always seek advice from advisors with relevant expertise, such as financial advisors, investment advisors, lawyers, accountants, or similar before completing an Investment.
Each offered Investment is unique, which is why it is of utmost importance that the Investor in each case evaluates both the Investment offer and the Property Company before completing an Investment. The Property Company is responsible for both the implementation and management of the investment, as well as the Investment offer in its entirety, including, but not limited to, its terms, forecasts, and any other obligations. The Investment offer is designed and approved by the Property Company.
The Investor acknowledges that the Investment offer can be interrupted at any time due to lack of interest or other reasons. The Investor is aware that the opportunity for duration will in many cases be small or non-existent. The Investment is not listed, so the Investor cannot dispose of it through an exchange or regulated marketplace. The Investor is also aware that individual debt instruments issued by Property Companies often cannot be transferred.
The Investor is fully responsible for their use of the Platform and any investment decisions made in connection therewith. The Investor is aware that an Investment is always associated with risk and that all or part of the invested capital may be lost. The Investor is also aware that certain Investments are associated with unusually high risk, including, but not limited to, construction risk, financial risk, liquidity risk, counterparty risk, and disposal risk. The Property Company will in many cases lack significant financial resources, which can result in an additional increased risk for the Investor.

Crowdster provides no guarantees or representations regarding content, information, calculations, computations, representations, or other presented on the Platform, regardless of whether this originates from the Property Company or not. Crowdster assumes neither direct nor indirect responsibility for the Investment offers, and an Investment is exclusively a matter between the Investor and the Property Company, with Crowdster being merely a link between these.
Crowdster also provides no guarantees or representations regarding the Platform or its functionality, availability, quality, usability, or security. Neither Crowdster nor the Platform has any direct or indirect connection, influence, or responsibility for the Property Company, Investor, or Investment offer. Crowdster does not prefer either the Property Company or Investor, makes no assessment of the Property Company and/or Investment offer, and provides no form of recommendation to any party regarding the Investment offer.
The Investor commits, without time limitation, to neither directly nor indirectly make claims or demands against Crowdster, its group or affiliated companies, owners, or management (board members, management, personnel, or consultants) regarding:i) The Platform not being availableii) Loss, direct or indirect, in connection with an Investmentiii) Not being offered to complete an Investmentiv) The Property Company not fulfilling its obligations and/or complying with relevant agreements, regulations, laws, or rulesv) Actions and/or decisions related to the investment not being adopted and/or adopted at the wrong time or incorrectlyvi) The Property Company providing incorrect or misleading information about itself, the Investment offer, or other matters
Crowdster is under no circumstances responsible for indirect damage or loss of income. Crowdster's maximum liability towards the Investor can under no circumstances exceed DKK 8,000.
The User Terms are regulated according to Danish law. All disputes related to the User Terms shall be finally resolved by arbitration in accordance with the "Rules for Processing Cases at the Swedish Arbitration Institute".
